No Further Action Outcome Following Pre-Charge Representations

Another strong result at the pre-charge stage

We recently secured a positive outcome for a client who had been facing two separate criminal allegations for rape and drug offences. We are pleased to say that both cases have been discontinued at the pre-charge stage following the submission of detailed written representations to the police.

After reviewing the material in detail, Senior Associate Solicitor Gary Monks, assisted by Adela Vata, identified a number of evidential difficulties in the case against our client. These included issues surrounding the reliability and sufficiency of the evidence, which were addressed directly and strategically in comprehensive written representations submitted on the client’s behalf.

Following consideration of those representations, the police determined that the evidential threshold was not met and confirmed that no further action would be taken in respect of both matters. This brought the case to an immediate conclusion without charge, avoiding the need for the client to face criminal proceedings.
