Case Result: Not Guilty Of Harassment

Contents

After a 3 day trial at Weymouth Magistrates Court, our client was successfully acquitted on a charge of Harassment (Contrary to Section 2 of the Protection From Harassment Act 1997).

This allegation was of a domestic nature, on the basis of a series of unrelated incidents, whereby the defence adduced evidence to support that this was not a course of conduct amounting to harassment.

Our Approach

The week before the trial we had successfully opposed a last minute prosecution application to vacate the trial. Extensive trial preparation was undertaken over a 12 month period. The trial involved numerous legal arguments, including an application to admit hearsay evidence, a Section 78 PACE application to exclude evidence on admissibility grounds and a non defendant bad character application which was successfully granted, admitting evidence of the complainants relevant non molestation order into the trial proceedings.

A Defendants Costs order was duly granted. Our client successfully retained his good character.

Our Team

This case was led by Andrew McArthur and Sara Mitchell with the assistance from Eva Georgieva and counsel was the exceptional Sophie Stevens of 9BR Chambers.

Understanding Harassment Allegations

Harassment is an offence under the Protection from Harassment Act 1997 and generally involves a course of conduct that causes another person alarm or distress. To secure a conviction, the prosecution must prove that there was a pattern of behaviour, rather than a single isolated incident, and that the conduct amounted to harassment in law.

Harassment allegations frequently arise following the breakdown of personal or family relationships and can involve claims relating to repeated communication, unwanted contact, social media activity or allegations of intimidation. These cases are often highly fact-specific and may rely heavily on witness evidence, digital communications and the credibility of those involved.

A conviction for harassment can have serious consequences, including a criminal record, restraining orders, fines and, in more serious cases, imprisonment. It can also affect employment, professional registrations and future opportunities.

As this case demonstrates, every allegation should be carefully scrutinised. A detailed examination of the prosecution evidence, thorough trial preparation and robust legal arguments can expose weaknesses in the case and result in an acquittal. At McArthur Solicitors, we have extensive experience defending clients accused of harassment and other criminal offences, providing strategic legal advice and expert representation at every stage of the proceedings.
